Personal Data Processing Policy

Jordy Fabián Villamil Letrado, an individual identified with Colombian citizenship ID 1.016.073.145, who operates under the trade name KinetiaDesign and can be reached at kinetiadesign@gmail.com, is the controller of the personal data collected through this website and its associated contact channels (form and WhatsApp).

• Contact data: name, phone/WhatsApp number, email address, company or business name.
• Browsing data: through Meta Pixel and similar tools, when the visitor accepts cookies (see section 6).
• The content of the conversation when the visitor writes through the contact form or WhatsApp.

• Answering requests for information and preparing quotes.
• Managing the contractual relationship with clients (invoicing, project delivery, support).
• Sending commercial communications about KinetiaDesign's services, unless the data subject has objected.
• Letting you know when the templates membership opens, only if you expressly joined the waitlist. You can unsubscribe at any time from the link included in those emails.
• Measuring and optimizing advertising campaigns on Meta Ads (Facebook and Instagram) through Meta Pixel.

Under Article 8 of Law 1581 of 2012, as the owner of your personal data you have the right to:

• Access, update and correct your personal data.
• Request proof of the authorization you gave for the processing of your data.
• Be informed of how your personal data has been used.
• Revoke your authorization and/or request the deletion of your data, where no legal or contractual duty prevents it.
• Access, free of charge, your personal data that has been processed.
• File complaints with Colombia's Superintendence of Industry and Commerce (SIC) for violations of data protection law.

You can exercise any of these rights by writing to kinetiadesign@gmail.com or to WhatsApp +57 300 115 6219, stating your specific request. KinetiaDesign will respond within the time limits set by Law 1581 of 2012 (inquiries: up to 10 business days; claims: up to 15 business days).

This site uses Meta Pixel to measure the performance of advertising campaigns on Meta Ads (Facebook/Instagram). This tool may collect browsing and on-site behavior data, which Meta Platforms, Inc. processes as a data processor under its own privacy policy. Visitors can manage their cookie preferences from this site's preferences panel and from their browser settings.

Data may be accessed by the technology providers KinetiaDesign uses to run the site and its campaigns, who act as data processors and are bound by their own privacy policies and applicable data protection standards. At present they are: Meta Platforms, Inc. (Meta Ads and Meta Pixel), Resend, Inc. (delivery of contact form messages and storage of the waitlist) and Cloudflare, Inc. (site hosting). These providers operate abroad, mainly in the United States.

KinetiaDesign takes reasonable technical and administrative measures to protect personal data against unauthorized access, loss or misuse, in keeping with the size and nature of its operation.

This policy is in force from its publication and remains in force for as long as KinetiaDesign processes personal data for the purposes described here.
